Court Rules Insurance Third Party Rights Rules Cannot be Applied Retrospectively
Ruling Date: 26th July 2017
UK Ruling: The High Court has confirmed that the 2010 Third Parties (Rights Against Insurers) Act does not have retrospective effect. The case in question concerned a claim brought by an employee's widow against the employer's insurer. However, the date of the employer's insolvency and the date of the alleged liability occurred prior to the Act's commencement.
