UK Court Rules Proof of Assets Needed for Worldwide Freezing Order
Ruling Date: 19th July 2017
UK Ruling: The Court of Appeal has ruled that an applicant for a worldwide freezing order (WFO) must be able to demonstrate that there are grounds for believing the subject of the order actually has assets that can be caught by the injunction. The judgement affirms that UK courts will not order a broad and speculative WFO over entities where there is uncertainty over the existence of assets.
